HALO ASIA LIMITED SUCCESSFULLY ENFORCES DESIGN PATENTS
Halo Asia Limited (Halo) has been successful in enforcing its Chinese design patents in six cases filed in the name of its licensed manufacturer in Foshan against Foshan DOB Furniture Co., Ltd. and Foshan Zhongrui Furniture Co. Ltd that have also been known to trade as Artsome, and Win Top Group Ltd.
In separate judgments issued on December 15 last year by the Foshan Intermediate People's Court, the Court upheld the validity of design patents for a number of Halo products, including its distinctive armchairs, sofas and chests, and found that the two defendants had infringed such patents by manufacturing and/or selling similar items.
In its judgments, the Court ordered the two defendants immediately to stop producing and/or selling the offending items, and held them jointly liable to pay a total of RMB440,000 in economic losses and investigation costs incurred by Halo’s licensed manufacturer in pursuing these cases.
According to Tim Guinan, Halo’s Group Operations Director, this represents a major breakthrough for his company in protecting its intellectual property rights in China and beyond. He said, “Halo is delighted by these favorable judgments, and we will continue to monitor the market for and take action against infringing activities by these two companies in Foshan and also by any purchasers of their products that infringe our protected designs.”
